Pittsburgh SWAT sued for 'terrorizing' young family at gunpoint ? RT ...

A Pennsylvania family has filed a lawsuit against the Pittsburgh police department, claiming that two dozen SWAT team members raided their home and terrorized their two children in retaliation for a prior incident involving an officer outside a local bar.

Surveillance video captured in December 2010 outside a Pittsburgh bar shows Michael Murray, an off-duty police officer, trying to help a bartender escort an unruly patron out of the establishment. A fight breaks out in the process, with another customer ? later identified as William Moreno ? jumping into the fray and throwing Murray to the ground.?

The policeman was knocked unconscious, his leg broken, and tooth chipped. Moreno, who would later be convicted of aggravated assault in 2012, left the bar to return home to his family.

A new lawsuit filed by Moreno?s wife alleges that on December 7, 2010 - less than 24 hours after the bar fight - a team of at least 23 officers dressed in full SWAT gear detonated flash grenades at the Moreno family?s door and forced their way into the house. Although the officers had a warrant and evidently sought to arrest William Moreno, they are accused of putting his family through 45 minutes of ?terrorization? in the process.?

The SWAT team allegedly handcuffed Moreno, his wife Georgeia, Georgeia?s stepfather, and Georgeia?s adult son Billy. In court, Georgeia said that Billy was forced to lie on broken glass. She recalled pleading with officers, telling them there were young children upstairs.?

?Then they threw us all on the ground and were handcuffing us, kicking us, screaming,? Georgeia Moreno told the Pittsburgh Post-Gazette. ?They had rifles pointed at our heads.??

At one point, the officers were too rough with the stepfather?s surgically repaired arm. He said the altercation necessitated another surgery.

?You think you can get one of ours, and we won?t get one of yours?? the officers are accused of saying.?

?They just ransacked the house,? said Tim O?Brien, the family?s attorney. ?Everything was done wrong. Everything they did was in complete disregard of the Constitution.??

According to the lawsuit, police then violently dragged Georgeia?s 10-year-old son from the bathtub, injuring his ankles. Officers reportedly humiliated the boy by forcing him to stand naked next to his four-year-old sister at gunpoint.

?Officers have continued to harass and threaten the family since the raid, telling them "That?s how we do things here" and that they should move out of Pittsburgh,? the complaint reads.?

The family is seeking $50,000 in damages, claiming the SWAT raid was in breach of their Fourth and Fourteenth Amendment rights. US District Judge Nora Barry Fischer refused to dismiss the case earlier this week, citing inconsistencies in officers? explanations and saying there is not a time limit by which the family would have needed to sue.?

William Moreno, who has a lengthy criminal record, is in the midst of serving an 8 ? to 20 year prison sentence for his role in the initial bar fight.

Summer Baseball: Ashland Sr. Babe Ruth tops Sudbury

Nick Cunningham threw a two-hit shutout and delivered a game-winning RBI single with two outs in the bottom of the sixth inning as second-seeded Ashland tipped visiting third-seeded Sudbury, 1-0, on Friday night in the third and deciding game of a Central Mass. Senior Babe Ruth North opening round playoff series.

Ashland (16-6) advances to play defending CMSBR World Series champion and top-seeded Medfield in the first game of the best-of-three North finals. The teams split two games during the regular season.

Sudbury finished the season with a record of 15-7.

Cunningham, who struck out five and walked one, won a pitching duel with Sudbury?s Tommy Novick, who finished with a four-hitter and seven strikeouts.

With the game scoreless, Seamus Reardon led off the Ashland sixth by reaching on an infield error. After moving to third on a Zach Blecher groundout to first, he came home with the winning run on Cunningham?s line drive hit between first and second and into right field.

Sudbury?s Kieran Pathak broke up Cunningham?s no-hit with single in the fourth. Matt Broadbent doubled with two outs top of the seventh but Cunningham needed it with a groundout to the mound.

Christian Reick went 1-for-1 with a single and walk, John Ciampaglia went 1-for-2 and Thomas Schelling had an infield single to lead off the fourth. Schelling reached second on a wild pitch, but Novick fanned the next three batters to get out of the jam.

"It was an exiting game," said Ashland coach Kyle Wilson. "Cunningham came through like he always does."

BELLINGHAM 11, MEDWAY 1: Taylor Sutherland went 2-for-3 with two RBIs and allowed just four hits in four innings on the mound as top-seeded Bellingham (17-4-1) beat visiting second-seeded Medway (11-11) in the first game of a best-of-three CMSBR South finals.

Jeff Dunn went 2-for-3 with two runs scored while Mike Ryan went 1-for-3 with a solo home run for Bellingham, which broke open the game with a seven-run third inning to make the score 9-1.

Kevin Bergeron went 2-for-3 with a double and a run scored for Medway. Jordan Krozy was 1-for-3 with an RBI, driving in Bergeron to give Medway a 1-0 lead in the first inning.

Game 2 is Saturday at 5:30 p.m. at Medway High School.

ASHLAND WINS BY FORFEIT: Ashland Post 77 (14-6) won its regular-season finale by forfeit against visiting Malden, as the guests didn't arrive until 6:50 for a 6 p.m. game.

"The umpires called it at 6:35. Usually we give teams 20 minutes, but it was getting too late," said Post 77 manager Dan Sullivan. "We had a Senior Babe Ruth playoff game scheduled for the same field at 8, so we couldn't wait."

Post 77 had already been eliminated from the Intrastate playoffs as Ashland was edged out by Billerica, which won the tiebreaker for the fourth and final playoff spot in Zone 5. Ashland will play in Zone 5?s Chairman's Cup beginning on Monday.

BILLERICA 12, NATICK 0 (6 INN.): Jack Turner went 1-for-2 with a double for Natick (6-14), but Post 107 fell to visiting Billerica in its regular season Zone 5 finale.

Post 107 was within one run after three innings, but two errors in the fourth allowed Billerica to score five runs, putting the margin at 6-0.

"We did well early, but that inning opened the floodgates. Only three of our runs were earned," said Post 107 manager Jeff Ward.

Jeff Bortman went 1-for-1 with a single.

Natick will play in the Zone 5 Chairman's Cup starting on Monday.

"Depending on how Lexington finishes in their last three games, we could get a home game in the first round," said Ward.

Dish's Ad-Skipping Hopper Wins Legal Fight Against the TV ...

Ergen_laughingThe broadcast networks have lost another legal battle against new technology: A federal appeals court has denied a request by 21st Century Fox to stop Dish Network from selling its ad-skipping AutoHop feature.

The Ninth Circuit Court of Appeals held up a ruling from last year that said Dish could keep selling the technology, which lets users automatically fast-forward through ads on recordings of prime-time network broadcasts.

You can read the ruling, embedded at the bottom of this post. It cites multiple precedents that will be familiar to people who follow tech-versus-TV fights, including the Sony/Betamax case and the Cablevision ?cloud DVR? case, and concludes that consumers have the right to record shows, and to fast-forward through the ads.

The ruling appears to leave open the door, at least a crack, for a Fox argument that the AutoHop feature violates terms of a distribution contract between Fox and Dish.

But we?ll have to see what Fox, which took on the case with the backing of the other broadcast networks, wants to do. Here?s their response, for now: ?We are disappointed in the court?s ruling, even though the bar to secure a preliminary injunction is very high. This is not about consumer choice or advances in technology. It is about a company devising an unlicensed, unauthorized service that clearly infringes our copyrights and violates our contract. We will review all of our options and proceed accordingly.?

And here?s Dish?s victory dance: ?DISH is pleased that the Ninth Circuit Court of Appeals has affirmed the district court?s 2012 order denying Fox?s preliminary injunction motion. In so doing, the courts continue to reject Fox?s efforts to deny our customers? access to PrimeTime Anytime and AutoHop ? key features of the Hopper Whole-Home HD DVR.

This decision is a victory for American consumers, and we are proud to have stood by their side in this important fight over the fundamental rights of consumer choice and control.?

The ruling comes in the same month that CBS and the other broadcasters lost a motion to re-hear a federal court ruling that favored Aereo, the startup that distributes broadcaster networks? programs over the Web without paying a license fee for the shows.

Golden years shorter, sicker in Southern states

(AP) ? If you're 65 and living in Hawaii, here's some good news: Odds are you'll live another 21 years. And for all but five of those years, you'll likely be in pretty good health.

Hawaii tops the charts in the government's first state-by-state look at how long Americans age 65 can expect to live, on average, and how many of those remaining years will be healthy ones.

Retirement-age Mississippians fared worst, with only about 17? more years remaining and nearly seven of them in poorer health.

U.S. life expectancy has been growing steadily for decades, and is now nearly 79 for newborns. The figures released Thursday by the Centers for Disease Control and Prevention estimate life expectancy for people 65 years old, and what portion will be free of the illnesses and disabilities suffered late in life.

"What ultimately matters is not just the length of life but the quality of life," said Matt Stiefel, who oversees population health research for Kaiser Permanente.

The World Health Organization keeps "healthy life expectancy" statistics on nearly 200 countries, and the numbers are used to determine the most sensible ages to set retirement and retirement benefits. But the measure is still catching on in the United States; the CDC study is the first to make estimates for all 50 states.

Overall, Americans who make it to 65 have about 19 years of life ahead of them, including nearly 14 in relatively good health, the CDC estimated.

But the South and parts of the Midwest clearly had lower numbers. That's not a surprise, experts said.

Southern states tend to have higher rates of smoking, obesity, diabetes, heart disease, and a range of other illnesses. They also have problems that affect health, like less education and more poverty.

These are issues that build up over a lifetime, so it's doubtful that moving to Hawaii after a lifetime in the South will suddenly give you more healthy years, they said.

After Mississippi, Kentucky, West Virginia and Alabama had the lowest numbers for both life expectancy and healthy life expectancy. States with the best numbers included Florida ? a magnet for healthy retirees ? as well as Connecticut and Minnesota.

The estimates were made using 2007 through 2009 data from the census, death certificates and telephone surveys that asked people to describe their health. The CDC's Paula Yoon cautioned not to make too much of the differences between states. Results could have been swayed, for example, by how people in different states interpreted and answered the survey questions.

Other findings:

? Nationally, women at 65 can expect nearly 15 more years of healthy life. Men that age can expect about 13 years.

? Blacks fared much worse than whites. They could expect 11 years of healthy life, compared to more than 14 for whites.

The CDC report makes "painfully clear" the disparities in the health of whites and blacks in their final years, said Ellen Meara, a health economist at Dartmouth College.

CAR statsAll corners of Colorado?s housing market enjoyed a robust second quarter, from the Denver area to the mountains, to agricultural rural pockets, according to a report released today by the Colorado Association of Realtors.

?Overall the picture for housing in Colorado is quite good with increased numbers of sales, higher median sales prices, and less time on the market ? regardless of which part of the market you consider,? according to the report.

?Lender-mediated sales as a percentage of overall sales declined in every area indicating further strengthening and stabilizing of the housing market,? the report continued.

Good Times

The CAR expects the good times to continue

?With higher prices comes some decline in affordability and with small inventories in most regions, competition for the best properties will likely continue,? according to the report.

Sales of single-family homes, condominiums and townhouses increased 16 percent in Colorado in the second quarter compared with the second quarter of 2012, according to the Quarterly Market Statistical Report released today by the CAR.

Here are some of its findings:

  • In total, there were 28,068 closings in the second quarter, 16 percent more than in the second quarter of 2012.
  • Year-to-date, sales rose almost 17 percent, compared with the first six months of 2012.
  • New listings also increased about 16 percent to 42,348 with growth in new townhouse-condo listings outpacing single-family homes.
  • The median sales prices statewide rose just over 8 percent to $260,000 for single-family homes and $170,000 for townhouses and condominiums compared to the first quarter 2012.
  • Days on the market continued a downward trend, down 25 percent for single-family homes and down 29 percent for townhomes and condos.
  • There were 33,256 active listings statewide, at the end of the second quarter, representing a 4.6-month inventory for single-family and a 4.1-month inventory for townhouses-condos.

?These figures are very encouraging, continuing trends we reported last quarter and in some instances showing even stronger improvement in our regional markets,? said CAR spokesperson, Karen Levine.

?Beginning this quarter we are able to report results separately for single-family and townhouses-condos. Drilling down even further on the statistics and market intricacies will help consumers better understand market trends and assist our Realtor members in serving both sellers and buyers successfully,? Levine continued. ?In both categories we are seeing more sales, increased median pricing and fewer days on the market.?

Meanwhile, sales of lender-mediated properties (properties owned by banks and other mortgage lenders) declined strongly as a percent of all sales, adding to the sense of recovery.?All regions of the state saw declines with the metro and mountain regions experiencing the largest drops, quarter to quarter.

Affordability

The CAR Housing Affordability Index, a newer statistical measure for Colorado?s housing market, showed declines in all areas of the state for both single-family and townhouse-condo listings.

This pattern should be expected as housing prices move up unless personal income increases at a comparable rate.

An index of 120 means the median household income in that area was 120 percent of what is necessary to qualify for the median-priced home under prevailing interest rates.

A higher number is usually interpreted as greater housing affordability. Higher values generally benefit buyers whereas lower values help sellers.

The greatest affordability during the second quarter of 2013 was in the townhouse-condo market in the Northwest Region, with an index number of 220. In comparison, the rates in the Mountain Region were 91 for single-family homes and 107 for townhouses-condos, the lowest readings for the quarter.

In addition to cumulative statewide statistics, CAR has released six regional reports:? Metro Denver Region

Sales of single-family homes in this region rose a modest 3 percent while townhouse-condo sales increased by more than 20 percent. The median sales price jumped 9 percent for single-family to $284,000 and nearly 13 percent to almost $164,000 for townhouses-condos.

One of the consequences of improved prices is that the Affordability Index for Metro Denver has dropped steadily during 2012 and into the second quarter 2013. By this measure alone, condos are significantly more affordable in the Metro area than single-family homes. This area of the state sees the fewest days on the market (45 for each kind of property) and experienced the largest drop in this measure quarter to quarter. The quarter closed with 12,450 active listings representing slightly less than a three-month supply.

Mountain Region (Garfield, Grand, Gunnison, Jackson, Pitkin, Routt, San Miguel and Summit counties.)

The number of new single-family listings increased 6 percent, while townhouse-condo new listings declined by 1 percent.

Sales increased for townhouses-condos by 7 percent and fell 1 percent for single-family homes.

The median sales price rose 14 percent to $397,000 for single-family and 12 percent to $334,250 for townhouses-condos in this region, which includes Colorado?s ski resort communities.

With just under 3,800 active listings, this region has approximately 13 months? supply of inventory which, in these areas of the state, is not unusual.

Lender-mediated property sales as a proportion of all sales declined significantly to 16 percent. Days on the market dropped more than 10 percent for single-family properties to 154, but rose 4 percent to 175 for townhouses-condos.

Northeast Region (Boulder, Larimer, Logan, Morgan, Weld counties)

This region of Colorado continues to see double-digit growth in new listings , up 15 percent, while sales were up 16 percent.

The median sales price rose 6 percent.

Both the quarterly and year to date new listings of single-family homes matched the rate of growth for townhouses-condos.

The number of townhouse-condo sales increased slightly more than single-family though the median price increase was significantly greater for single-family (9 percent versus 4 percent). Days on the market are identical at 81, an average 25 percent drop over the same quarter last year. The region had nearly ,6000 homes available at the end of the quarter, representing a 4-5 month supply.

Northwest Region (Delta, Hinsdale, Mesa, Moffat, Montrose, Pitkin, Rio Blanca counties.)

This region had a sixth consecutive quarter of increased new listings, up 14 percent compared to the second quarter of 2012 attributable entirely to an increase in single-family listings as townhouse-condo listings remained flat.

Single-family sales rose by 6 percent and the median price on those homes increased 3 percent to $175,000. The townhouse-condo market did not fare as well on sales, as they were down 11 percent. The median price, on the 66 properties sold, however, rose 12 percent to $141,225 compared to the same quarter last year.

This area of the state experienced another large drop in lender-mediated sales, down 27 percent and enjoyed the highest Affordability Index at 222 for townhouses-condos.

Southeast Region (Baca, Chaffee, Crowley, Custer, El Paso, Freemont, Huerfano, Las Animas, Otero, Pueblo and Teller counties)

Southeast Colorado home sales increased 19 percent to 4,346 during the second quarter of 2013 compared to 2012. New listings increased by 17 percent and the median price rose 7 percent.

New listings of townhouses and condos outpaced single-family homes, 30 percent versus 16 percent, as did sales, which rose by 33 percent, compared with 18 percent.

The median price for single-family homes rose to $200,000 and for townhouses-condos, to $136,000.

Days on the market are among the best in the state with drops of 16 percent to 84 days for single-family homes and 23 percent to 72 days for townhouses-condos. There were about 8,400 properties available in this region at the end of the quarter representing a seven-month supply.

Southwest Region (Alamosa, Archuleta, Conejos, Costilla, Dolores, Hinsdale, La Plata, Mineral, Montezuma, Saguache and San Juan counties.)

The Southwest Region experienced the largest increase in the state for sales , rising 22 percent rise, while the median price of a home rose 22 percent. There were 562 properties sold during the second quarter.

Though the number of townhouse-condo sales increased more significantly than single-family homes quarter to quarter, the median price for those properties actually declined 13 percent to $178,300.

The single-family home sales, which represented 85 percent of the quarterly sales, increased in median value by 30 percent to $249,500.

Days on the market dropped for single-family homes by 10 percent and rose 2 percent for townhomes and condos.

With more than 2,500 properties available at the end of the quarter, there are sufficient single-family listings to last 16 months and townhouse-condo listings to last 12 months.

Senators call on Obama to act over Cuban arms shipment to North Korea

Leading Republican and Democrat senators called on President Barack Obama to act over a Cuban shipment of weapons and equipment to North Korea, as talks got under way about migration between the U.S. and Cuba.

A North Korean ship was stopped by Panama as it headed home with a cargo of rockets, missile parts and two Cold War-era fighter jets hidden among sacks of brown sugar.

United Nations sanctions ban the export of most military equipment to North Korea, though Havana said it was sending ?obsolete? hardware to be repaired and then returned to Cuba.

Sen. Robert Menendez, the Democrat who chairs the Senate Foreign Relations Committee, said in a statement that the shipment was ?a grave violation of international treaties.?

?Weapons transfers from one communist regime to another hidden under sacks of sugar are not accidental occurrences, and reinforces the necessity that Cuba remain on the State Department?s list of countries that sponsor state terrorism,? he said.

A ship stocked with weapons and missiles was intercepted near the Panama Canal traveling from Cuba to North Korea.

?In addition to possible violations of Panamanian law, the shipment almost certainly violated United Nations Security Council sanctions on shipments of weapons to North Korea and as such, I call on the Obama administration to submit this case to the U.N. Security Council for review,? he added.

Sen. Marco Rubio, who gave the Republican response to Obama?s State of the Union address this year and is a member of the Senate Foreign Relations Committee, said in a letter to Secretary of State John Kerry that the discovery of the shipment should ?finally prompt the administration to re-calibrate its misguided and na?ve Cuba policy.?

He said the U.S. should ?immediately reverse its January 2011 decision easing restrictions on people-to-people travel and remittances sent to Cuba; as well as immediately halt granting visas to Cuban government officials.?

Rubio said Cuba?s actions were a ?flagrant violation? of U.N. sanctions and ?the latest reminder of the true nature of the Cuban regime.?

?I urge the Administration to take meaningful action to send a clear message that Cuban collusion with North Korea to undermine the international nonproliferation system carries heavy consequences,? he said.

Like Menendez, he also said the U.S. should raise the matter at the U.N. Security Council.

Both Rubio and Menendez are Cuban-Americans known as tough critics of Cuba's communist government.

Their comments, on Wednesday, came as Cuba?s delegation to Washington issued a statement saying talks with their U.S. counterparts took place in a ?climate of respect.?

?A review was made of the evolution of the migration accords in force between the two countries and the main results of the individual and joint actions undertaken by the Parties to cope with illegal migration and alien smuggling,? the Cuban statement said.

It said also Cuba had ratified protocols to prevent people trafficking and smuggling of migrants.

U.S. officials said that they had used the meeting to again press Cuba to release jailed American contractor Alan Gross.

Gross is serving a 15-year sentence for installing Internet networks for Cuban Jews as part of a U.S. program that Cuba considers subversive.

Gross' arrest in late 2009 and sentencing in March 2011 halted a brief thaw in U.S.-Cuba relations after Obama took office in January 2009.

U.S. officials have said they plan to raise the issue of the weapons shipment to Cuba soon.

Meanwhile, international vessel tracking monitor IHS Fairplay said that it had established that five North Korean cargo ships had made similar journeys since 2010, including the O Un Chong Nyon Ho, which docked in Havana, Cuba, in May last year.

'Brown ocean' can fuel inland tropical cyclones

Most tropical cyclones dissipate after making landfall, weakened by everything from friction and wind shear to loss of the ocean as a source of heat energy. Not Erin. The storm intensified as it tracked through Texas. Erin is an example of a newly defined type of inland tropical cyclone that maintains or increases strength after landfall. Storms in the newly defined category derive their energy from the evaporation of abundant soil moisture -- a phenomenon that experts call the "brown ocean."

In case you haven?t noticed, the Google Play Store web site?s design has just been refreshed. And now things look a lot more like what they do on the Android version of it ? that is, the Google Play Store app. You may check out the new design yourself right now by going to play.google.com.

According to a post on the official Google Play page on Google+, the fresh new look will allow users to ?play like never before? in search of apps and other downloadables for their Android-powered devices. Navigation has been simplified and apps are now at the forefront of the Play Store experience ? ?Recommended? stuff now sit atop the home page with plenty of unused space to go around.

In the past, the web-based Google Play store seemed robust. But now it?s the opposite. It looks like there are fewer options now than there were before. But that doesn?t mean you can do less with the redesigned Play Store, of course. It seems that Google just wanted to make the Web version function more like its Android counterpart, focusing more on apps and the most important Play Store sections only.

The new Play Store design may not be for everyonem=, but at least some of the useful old elements were kept. The omnibar can still be found at the topmost portion of the page, and the Settings cog is still there near the top-right corner of the screen. In any case, you should at least give the new look a try before you pass judgment on it yourself.
